GRAND RAPIDS, Mich. (WOOD) — The alleged victim has returned to the stand for the third day this week to be cross-examined by the defense.
The attorney for former tutor Abigail Simon framed his case for the judge on Wednesday, saying text messages and other evidence show the underage student she had sex with was the aggressor and that the tutor was under “duress.”
It was another argument, without the jury present, about just how much the defense should be allowed to talk about the victim’s alleged past — at least the past he described in racy text messages.
In some texts to a friend, the victim allegedly talked about who would win the “race” to be first to have sex with another female, a high school student. He also talked about having sex with the girl and never talking to her again. The victim testified he didn’t…
